These Terms of Service ("Terms") govern your access to and use of XLEMETY (the "Platform"). By creating an account or using the Platform in any capacity — as a Learner, Coach Teacher, Native, or Recruiter — you agree to be bound by these Terms. If you do not agree, you should not use the Platform. For a full plain-language explanation of what XLEMETY is and how the whole system fits together, see How XLEMETY Works.

1. Who Can Use XLEMETY

The Platform is intended for users 18 years of age or older. By creating an account, you confirm that you meet this requirement and that all information you provide is accurate and current.

Access to certain roles carries additional requirements:

Coach Teacher — Coach Teachers are exclusively non-native English speakers. Every applicant must take XLEMETY's own placement assessment and score at a B2 or C1 level before they are approved to teach on the Platform. This assessment evaluates real communicative and cultural fluency — how English speakers from North America and the United Kingdom actually communicate day to day (idiomatic expressions, register, indirect phrasing, workplace courtesy, and tone) — not grammatical accuracy alone. Applicants who do not reach this bar are not approved.
Native — availability is limited to users who meet the country-of-residence eligibility currently supported by the Platform, subject to identity verification. Native accounts are reserved for Real Mode, Team Challenge, and XLEMETY Live, and never used for Coach Mode.
Recruiter — availability requires a valid corporate email domain and successful business verification before candidate data becomes visible.

What "Coach Teacher" actually certifies. A B2 or C1 placement score on its own tells you someone can read, write, and understand English at a high level. It does not, by itself, tell you they can teach a student how a real conversation with a native speaker actually sounds and feels. That's why XLEMETY's Coach Teacher qualification specifically tests real-world communicative competence — recognizing and correctly using common North American and British idioms, understanding indirect or understated phrasing (e.g. a British "that's not bad, actually" as genuine praise), and adjusting tone and formality appropriately between a casual and a professional context. A Coach Teacher approved on the Platform has demonstrated this, not just textbook grammar.

2. The Service

XLEMETY provides English communication practice and assessment through several modes, including but not limited to Coach Mode (live sessions led by a real, non-native Coach Teacher who has demonstrated real cultural and communicative fluency — not grammar knowledge alone — small-group by default at a 2:1 ratio with a paid 1:1 upgrade available per session), Real Mode, Team Challenge, and XLEMETY Live (real-time sessions with real Native participants), plus optional specialty sessions for targeted professional contexts (technical interviews, business meetings, exam preparation, and similar). Available modes, features, and access levels may vary based on your subscription plan and role, and may change over time as the Platform evolves.

Every teaching and conversation session on XLEMETY is led by a real, live human — never an AI character, a bot, or pre-recorded dialogue. Your Coach Teacher or Native corrects your pronunciation, grammar, and word choice live, in real time, as part of the session itself. The only fully automated components of the Platform, with no human on the other side, are the Placement Test and the Level Exam, used strictly to measure your level. Behind the scenes, the Platform also computes automated objective metrics (grammar patterns, pacing, vocabulary range) from your real sessions to show your trend over time, and tracks your practice consistency through a Momentum indicator — this tracks progress alongside your coach's live correction, it does not replace it.

Progression starts wherever your Placement Test places you (A2 through C1) and advances automatically when you pass the Level Exam for your current level. Level Exams weigh real spoken communication — speaking and listening — more heavily than isolated grammar recall, consistent with the Platform's focus on practical fluency over textbook accuracy.

3. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized use of your account. XLEMETY is not liable for losses resulting from unauthorized access caused by your failure to safeguard your credentials.

One account per person. Sharing accounts, impersonating another individual, or creating multiple accounts to circumvent usage limits is not permitted.

4. Subscriptions, Billing, and Fair Use

XLEMETY is a paid Platform at every level, A2 through C1 — every ongoing plan requires an active subscription, because each session involves the real time of a Coach Teacher or Native. New learners receive one free trial session before subscribing, so you can experience a real live session before committing to a plan. Beyond that trial, by subscribing you authorize XLEMETY to charge the applicable fees to your chosen payment method on a recurring monthly basis, according to the level, plan, and pace you select.

Subscriptions renew automatically at the end of each billing cycle unless cancelled before the renewal date.
You may cancel at any time through your account settings. Cancellation stops future billing but does not entitle you to a refund for the current billing period, except where required by applicable law.
Prices, plans, and included features may change. Where required, we will provide advance notice of material changes to pricing for active subscribers.
Payment processing is handled by a third-party payment provider. XLEMETY does not store your full payment card details.

Fair Use Policy — how session limits actually work. Each plan includes a set number of Coach and Experience sessions per billing cycle, because every session is a real person's live time, not a recording. Unused sessions do not carry over to the next cycle — the same principle used by gym memberships and phone plans. However: a session you've already booked is always protected, even if it falls just after your cycle resets, and the Platform sends automatic reminders if a cycle is ending with sessions still unused, so you're never caught off guard.

Entering an Experience session (Real Mode, Team Challenge, or XLEMETY Live) counts as one of your monthly sessions the moment you enter it — regardless of the reason it doesn't finish: a technical issue, a change of mind, or finding it more difficult than expected. If you're not confident you can complete a full session, we recommend waiting until you can. This mirrors how a booked appointment works anywhere else: the time was reserved and made unavailable to anyone else.

If a Coach Teacher or Native fails to join your session, that is treated as a Platform fault, never yours — you are automatically offered a reassignment, or a free reschedule that does not count against your plan.

5. Recruiter Access and Candidate Visibility

Recruiter accounts, once verified, may access learner performance data made visible under the Recruiter's subscription tier, subject to the monthly contact limits defined in that plan. Candidate visibility to Recruiters requires the Learner's explicit, opt-in consent, given during profile setup — see Section 6 below. Recruiters agree to use candidate information solely for legitimate recruiting purposes and not to redistribute, resell, or use it for any purpose outside the scope of the Platform.

Learners retain control over what performance data is made visible to Recruiters, consistent with the options available in their account settings, and may withdraw that visibility at any time.

6. XLEMETY Is Not a Recruitment Agency

XLEMETY is an English performance platform. It is not a recruitment agency, staffing firm, or employment service, and it does not act as an intermediary, representative, or agent for either Learners or Recruiters in any hiring process. XLEMETY does not conduct interviews, does not screen candidates on behalf of companies, and does not participate in, influence, or guarantee the outcome of any hiring decision.

Verified Recruiters may discover a Learner's public talent profile — including objective performance metrics — only where that Learner has explicitly checked the consent box "I agree that verified companies may view my public talent profile and contact me directly" during profile setup. Any contact, interview process, offer, or hiring decision that follows takes place directly and exclusively between the Recruiter and the Learner, entirely outside the Platform. XLEMETY assumes no responsibility for the outcome, terms, or conduct of any resulting employment relationship.

7. Certificates and Assessment Results

XLEMETY issues a certificate each time you pass the Level Exam for a level — A2→B1, B1→B2, and B2→C1 — not only upon reaching the final tier. C1 remains the flagship credential, reflecting the highest standard the Platform measures, but every level you pass generates real, dated evidence tied to that specific assessment.

Certificates and scores reflect performance in specific scenarios and sessions conducted through the Platform, assessed through a combination of automated evaluation and live human interaction with real Coach Teachers and Native speakers. They are not an official academic degree and are not endorsed by any government or Ministry of Education. XLEMETY does not guarantee that any certificate or score will be recognized or accepted by any third party, including employers or educational institutions.

8. Acceptable Use

When using the Platform — particularly in live sessions with other users — you agree not to:

Harass, threaten, discriminate against, or abuse other users.
Share sexually explicit, hateful, violent, or otherwise unlawful content.
Attempt to circumvent evaluation systems, usage limits, or verification requirements.
Use the Platform for any purpose other than genuine English communication practice and assessment.
Record, distribute, or publish another user's likeness, voice, or personal information obtained through a session without their consent.
Reverse-engineer, scrape, or attempt to extract the Platform's underlying systems, models, or content libraries.

XLEMETY reserves the right to suspend or terminate accounts that violate these Terms, at its discretion, with or without prior notice depending on the severity of the violation.

9. Intellectual Property

All scenario content, scoring methodology, branding, and platform software are the property of XLEMETY or its licensors and are protected by applicable intellectual property laws. Your subscription grants you a limited, non-transferable, non-exclusive license to use the Platform for personal or business purposes consistent with your role — it does not grant ownership of any underlying content or technology.

10. User-Generated Content

Content you provide — including spoken responses, session interactions, and any feedback you submit — may be processed to operate and improve the Platform, including for scoring, error-pattern memory, and quality purposes, consistent with our Privacy Policy. You retain ownership of your own content but grant XLEMETY the rights necessary to use it for these purposes.

11. Disclaimers

The Platform is provided "as is" and "as available." XLEMETY does not guarantee that the service will be uninterrupted, error-free, or that automated objective metrics will be perfectly accurate in every instance. Language learning outcomes depend on individual effort and circumstances, and XLEMETY makes no guarantee of specific results, including but not limited to fluency level, certification outcomes, or employment outcomes.

On realistic timeframes. Genuine English fluency takes real, sustained time to build — independent research (including CEFR-aligned benchmarks) estimates several hundred hours across levels, depending on your starting point and pace. XLEMETY does not promise fluency by a specific date, and treats any such claim by a competing service with the same skepticism we'd want you to apply to ours. 12. Limitation of Liability

To the maximum extent permitted by applicable law, XLEMETY and its operator shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of data, loss of opportunity, or issues arising from interactions with other users or with Recruiters. Nothing in these Terms limits liability that cannot be excluded under applicable law.

13. Termination

You may stop using the Platform and delete your account at any time. XLEMETY may suspend or terminate your access if you violate these Terms, engage in fraudulent activity, or misuse the Platform. Upon termination, your right to use the Platform ends immediately; certain data may be retained as described in our Privacy Policy.

14. Changes to These Terms

We may update these Terms periodically to reflect changes in the Platform or applicable law. Material changes will be communicated through the Platform or by email. Continued use of XLEMETY after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of Colombia, without regard to conflict-of-law principles, except where mandatory local consumer protection laws in your jurisdiction provide otherwise.
